Who gets alimony in Florida and why?

Those people that get alimony in Florida are either able to reach an agreement between them and their former spouse to receive alimony or convince a court that alimony is a legal entitlement of theirs based upon their surrounding, mostly financial, circumstances. If you are asking for alimony, think of it as a two-hurdle race. You have to clear both hurdles in order to get the alimony. The first hurdle is referred to, in this office anyway, as the need and ability to pay alimony. The first party has to have the ability to pay it and the second party has to have the need. Well, that exists in a lot of cases, but that’s not the end of the analysis. There’s then the second hurdle which consists of 12 factors which are enumerated in the Florida statutes, such as the duration of the marriage. Did someone stay home and raise children? The health of both parties, and so on and so forth. The last of which factors are any and all other necessary factors to do equity injustice which leaves it wide open. That is how a judge determines whether or not alimony should be payable in any particular case.
