What is the statute of limitations on bringing a securities fraud claim?

The statute of limitations concerning a securities fraud claim being brought through FINRA is really a moving target. It is less precise than the concept of a statute of limitations when going through traditional litigation in the court system.

That aside, a statute of limitations will depend upon the facts. They can be as short as two years, or as long as six years. Then there is always the question of when do they start. Does the clock start when the action occurred, or when the investor found out about the action? That’s always one of the fundamental question.

As you can see, again the statute of limitations is somewhat of a moving target, but you can usually refine that target by talking to an attorney who is familiar with investing and the FINRA process.
