The typical process for preparing a prenuptial or postnuptial agreement is as follows. Each step is deliberate — designed to protect your interests, ensure full understanding, and produce an agreement that will hold up if it is ever challenged.
We begin with a brief introductory phone conference, typically lasting 15 to 30 minutes. There is no charge for this call.
After financial arrangements are made, we schedule an in-depth initial consultation. David meets with his client only — not both parties. This session is a thorough deep dive into your specific facts and circumstances, covering:
The first draft of your agreement — including your footnoted net worth statement — is prepared and emailed to you for review.
We review the first draft together and make any needed changes. The second draft is then either reviewed together again or sent to your fiancé and/or their attorney for their review. If further changes are requested, those are addressed before moving forward.
Once all parties are satisfied, a signing is scheduled. This is a critical step and must be executed correctly — it involves four persons: both clients and both attorneys, along with witnesses and a notary. The signing can take place together or separately.
An important note: Your attorney does not meet or speak with your fiancé unless their attorney is also present. Your attorney does not provide legal advice to your fiancé under any circumstances — protecting you from any future claim that the other party was advised or influenced by your counsel.
